A doctor’s affidavit filed late shouldn’t have been enough to reject a medical negligence lawsuit, a state appeals panel ruled Monday.The 1st District Appellate Court found Cook County Circuit Judge John H. Ehrlich abused his discretion when he dismissed Earnest and Mildred Lee’s lawsuit against Rush Oak Park Hospital and Dr. Juan Cobo because they did not file their health professional’s report within a 90-day window.Ehrlich granted the Lees two other extensions for filing similar affidavits in …
