A tire company will not have to face a lawsuit accusing it of liability in a collision that killed one of its employees. In a written opinion last week, U.S. District Judge John Z. Lee threw out the wrongful-death and survival claims brought against Pomp’s Tire Service Inc. on behalf of the estate of Dustin Webster. Lee held the Illinois Workers’ Compensation Act bars the claims. The estate filed the suit in LaSalle County under Illinois law.
