Tax challenge goes up in smoke

A city tax on non-cigarette tobacco products was wrongly struck down as unconstitutional, a state appeals panel ruled last week.The 1st District Appellate Court’s Dec. 20 decision reversed the partial summary judgment Cook County Circuit Judge Ann Collins-Dole granted to a coalition of tobacco retailers who challenged the Other Tobacco Products (OTP) ordinance passed by City Council in March 2016.Key to the ordinance’s fate is a 1993 amendment to the Illinois Municipal Code that states a home-rule municipality …
